According to the Commission Decision (2006/422/EC), the Procurement Directive does not apply to procurement contracts concluded by contracting entities for the purpose of enablin g their production or sale of electricity in Finland, with the exception of the Åland Islands. Based on the above, the Supreme Administrative Court has ruled in its decision 2013:2013 that the Procurement Act does not apply to procurements related to the Ämmässuo gas power plant.
